Terms and Conditions of Sale
THE CUSTOMER AGREES TO BE BOUND BY THIS SALE AGREEMENT AND ACCEPTS ITS TERMS AND CONDITIONS
This Sale Agreement is a legal contract between the Customer and HawksHead Systems Inc. The Customer accepts this Sale Agreement by making a purchase, placing an order, or otherwise shopping on the Site. The terms and conditions of this Sale Agreement are subject to change without prior notice, except that the terms and conditions posted on the Site at the time the Customer initially places or modifies an order will govern the order in question. All claims for shortage, or shipment error must be made within the first 3 days of arrival.
In the event of any conflict between the terms and conditions stated on your purchase order and this Sale Agreement or any terms and conditions, you agree that the provisions of this Sale Agreement shall control.
No returns will be accepted without an RMA number. RMA numbers can be obtained by emailingSupport@HawksHeadSystems.com. Any merchandise returned without an RMA number will be refused and sent back to the customer at customer's own expense. An RMA number is valid 30 days from issued date and products should be returned 100% complete with ALL original box(es) and packaging materials, have originalUPC codes on the box(es), manuals, CDs and other accessories and documentation supplied. A restocking charge of 20% will apply for items not returned in an as shipped condition.
All returns for refunds/exchanges must be made within 30 days from the date of purchase
The Customer pays shipping for all returns to HawksHead Systems Inc. HawksHead Systems Inc will pay for any return shipping to the customer in USA and Canada. Shipping charges are non-refundable.
RMA number must be visible on all return shipments or may be refused and returned back to you. Proof of purchase must be included in the returning package.
HawksHead will, within 12 months from date of original purchase, repair or replace free of charge any defective component (except batteries) which upon careful inspection is found, in our sole judgment, to have material or manufacturing defects, provided it is received freight prepaid, accompanied by the original purchasers sales slip and an authorized Return Merchandise Authorization number (RMA #.). You may obtain anRMA# by emailing Support@HawksHeadSystems.com Physical damage will void all warranty.
DISCLAIMER OF WARRANTY: Neither the seller nor the manufacturer will be liable for any loss damage or injury directly or indirectly arising from the use or inability to determine the use of this product. Before using, the user shall determine the suitability of the product for its intended use, and the user shall assume all responsibility and risk in connection herewith.
PLEASE NOTE: SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG IMPLIED WARRANTIES MAY LAST OR DO NOT ALLOW EXCLUSIONS OR LIMITATIONS OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THOSE EXCLUSIONS OR LIMITATIONS MAY NOT BE APPLICABLE TO YOU.
This Agreement and any sales hereunder shall be governed by the laws of the Province of British Columbiawithout regard to conflicts of laws rules. The customer consents to the jurisdiction of the Provincial courts located in Vancouver, British Columbia, for purposes of any suit, action or proceeding arising out of this Sale Agreement
